{"id":4094,"date":"2016-07-26T14:50:10","date_gmt":"2016-07-26T09:20:10","guid":{"rendered":"http:\/\/13.201.39.237\/?p=4094"},"modified":"2016-07-26T14:50:10","modified_gmt":"2016-07-26T09:20:10","slug":"indian-government-constitution-bjp-ministers","status":"publish","type":"post","link":"https:\/\/www.arre.co.in\/?p=4094","title":{"rendered":"Why Is Our Government Insistent on Changing the Constitution?"},"content":{"rendered":"\n<div class=\"container page-content\"><p><span class=\"dropcap\">T<\/span><\/p><\/div><p>he Constitution of India turns 69 years old today, which, in Indian politics, is positively youthful. In fact, our Constitution is only a few months older than our Prime Minister, and yet, it has been alleged that he feels like it needs to change with the times. Narendra Modi\u2019s celebration of the legacy of <\/span><a href=\"https:\/\/www.arre.co.in\/series\/whats-up-with\/hindutva-pop-obsession-indians\/\"><span style=\"font-weight: 400;\">Hindutva<\/span><\/a><span style=\"font-weight: 400;\"> ideologue Deen Dayal Upadhyay provides a window into his opinion of the Constitution. In his writings, Upadhyay said the Constituent Assembly, which authored the Constitution, could \u201cthink only on the lines of the west\u201d, and that \u201can un-Indian element\u201d had crept into the Constitution, which should have been drafted in Hindi, according to him.<\/span>\n\n<span style=\"font-weight: 400;\">This flippant attitude toward the very document that gave shape to modern India comes through when Modi directly <\/span><a href=\"https:\/\/timesofindia.indiatimes.com\/india\/kerala-govts-stand-on-sabarimala-is-shameful-pm-narendra-modi\/articleshow\/67549220.cms\"><span style=\"font-weight: 400;\">questions<\/span><\/a><span style=\"font-weight: 400;\"> why the Kerala state government complied with the Supreme Court verdict that allowed women entry to Sabarimala Temple. According to the Constitution, no government, at the Centre or state level, can refuse to implement an order from the Supreme Court, but the ruling party either doesn\u2019t know or doesn\u2019t care. <\/span>\n\n<span style=\"font-weight: 400;\">In 2017, BJP Union Minister Anant Kumar Hegde spoke at an event in Karnataka, where he proudly <\/span><a href=\"https:\/\/www.ndtv.com\/india-news\/we-are-here-to-change-the-constitution-says-union-minister-anant-kumar-hegde-in-new-controversy-1792197\"><span style=\"font-weight: 400;\">announced<\/span><\/a><span style=\"font-weight: 400;\">, \u201cThe Constitution has been changed many times before. We are here and we have come to change the Constitution. We will change it.\u201d He later went on to add, \u201cIf someone says, \u2018I am secular,\u2019 I get suspicious. I hope there are no secularists here.\u201d While he\u2019s correct that the Constitution has been amended in the past, his views on secularism are alarming, and indicate what is foremost on his agenda when it comes time to actually \u201cchange\u201d the Constitution.<\/span>\n\n<span style=\"font-weight: 400;\">Hegde is not alone in his suspicion toward a secular society. Uttar Pradesh CM Yogi Adityanath has <\/span><a href=\"https:\/\/www.ndtv.com\/india-news\/yogi-adityanath-says-secular-word-the-biggest-lie-since-independence-1775109\"><span style=\"font-weight: 400;\">stated<\/span><\/a><span style=\"font-weight: 400;\">, \u201cI believe the biggest lie in India after independence is the word secularism. The people who introduced this word and people who still use this word, should apologise to the country and its citizens.\u201d Both Adityanath and Hegde occupy senior positions in the BJP, and both of them have expressed intentions toward striking down one of the principles enshrined in the Preamble to the Constitution.<\/span>\n\n<blockquote class=\"quote--center\"><p>While critics of the Constitution continue to grind their teeth over secularism, they would do well to look to the historic hearings that saw Section 377 struck down.<\/p><\/blockquote> \n\n<span style=\"font-weight: 400;\">It\u2019s enough to lend credence to <\/span><a href=\"https:\/\/www.ndtv.com\/india-news\/bjp-planning-major-assault-on-constitution-shashi-tharoor-1810236\"><span style=\"font-weight: 400;\">claims<\/span><\/a><span style=\"font-weight: 400;\"> made by Shashi Tharoor, who has stated in interviews that he believes the BJP is planning a \u201cmajor assault on the Constitution\u201d. The way BJP leaders have explicitly stated their desire to scrub secularism from India has rubbed off on the public as well. In August last year, reports emerged of a group of activists burning a copy of the Constitution in Delhi while raising anti-Ambedkar slogans.<\/span>\n\n<span style=\"font-weight: 400;\">What\u2019s ironic is that even though most people know are Bhimrao Ambedkar was the chief author of the Indian Constitution, the words \u201csocialist\u201d and \u201csecular\u201d, possibly the most divisive words in the Preamble, were not penned down by him. In fact, Ambedkar along with Nehru were wary to include the word \u201csecular\u201d in the Preamble. The terms were added in 1976, as part of the <\/span><a href=\"https:\/\/indianexpress.com\/article\/research\/anant-kumar-hegde-secularism-constitution-india-bjp-jawaharlal-nehru-indira-gandhi-5001085\/\"><span style=\"font-weight: 400;\">42nd Amendment<\/span><\/a><span style=\"font-weight: 400;\">. Passed by the Indira Gandhi-led government, it was the most controversial Amendment of the Constitution in Indian history, as it clamped down on certain powers of the judiciary and state governments, transferring them to the Centre instead. <\/span>\n\n<span style=\"font-weight: 400;\">Funnily enough, this unitary model of statehood was exactly what the present <\/span><a href=\"https:\/\/www.arre.co.in\/politics\/state-assembly-bjp-bhakts\/\"><span style=\"font-weight: 400;\">BJP\u2019s<\/span><\/a><span style=\"font-weight: 400;\"> ideological lodestone Deen Dayal Upadhyay preferred over the union of states model. After Indira Gandhi\u2019s government was defeated in the next election by the Janata Party (which merged with BJP in 2013), many of the measures of the 42nd Amendment were rolled back, but the terms \u201csocialist\u201d and \u201csecular\u201d remained.<\/span>\n\n<span style=\"font-weight: 400;\">Clearly, this has become a pet peeve of the BJP, and they\u2019re intent on getting rid of those words. So far, the most significant changes to the Constitution during the party\u2019s current term are ones they didn\u2019t have much to do with. Foremost among those would have been the striking down of <\/span><a href=\"https:\/\/www.arre.co.in\/social-commentary\/sec-377-queer-men-internet\/\"><span style=\"font-weight: 400;\">Section 377<\/span><\/a><span style=\"font-weight: 400;\">, which criminalised homosexuality \u2013 not exactly the kind of hill on which the present crop of BJP lawmakers would choose to die. But while critics of the Constitution continue to grind their teeth over secularism, they would do well to look to the historic hearings that saw Section 377 struck down. After the law was struck down, Menaka Guruswamy, the lawyer who argued against it said in an interview, \u201cThe beauty of the Constitution is it compels us to unlearn the prejudices that we hold true.\u201d<\/span>\n\n<span style=\"font-weight: 400;\">Maybe instead of viewing secular principles as a threat to their vision for India, the BJP ministers could unlearn some of their prejudices instead. The <\/span><a href=\"https:\/\/www.arre.co.in\/humour\/republic-day-floats-india\/\"><span style=\"font-weight: 400;\">Republic Day<\/span><\/a><span style=\"font-weight: 400;\"> is as good as any to start.<\/span>\n","protected":false},"excerpt":{"rendered":"<p>BJP ministers Anant Kumar Hegde and Yogi Adityanath have made it amply clear that they\u2019d like to change the Constitution, the word secular particularly.
